67Figures & FSCH Affiliate Agreement, Terms & Disclosures

Important: This agreement is a business template for review and electronic acceptance. 67Figures should have Texas counsel confirm the correct contracting entity, address, dispute forum, restrictive covenants, privacy language, and tax procedures before public launch.

1. Parties and acceptance

This Affiliate Agreement (“Agreement”) is between the applicant (“Affiliate”) and 67Figures.com together with its designated operating entity (“67Figures”). By checking the acceptance boxes, typing the Affiliate’s full legal name, and submitting the application, Affiliate agrees to this Agreement and consents to electronic records and signatures. The electronic record may include the Agreement version, typed signature, acceptance date and time, network address, browser information, application information, and referral code.

2. Eligibility and verification

Affiliate enrollment is free, and professionals and nonprofessionals may apply. Participation is subject to review and approval. Affiliate must provide accurate, current information. Licensed agents and brokers must provide their license number, licensing state, brokerage or company legal name, and role, and obtain any broker or employer approval required by law or policy. Investors must provide the legal name and type of their investing entity. 67Figures may verify licenses, business identities, participant status, tax information, and compliance.

3. Covered programs and commission tiers

This Agreement may cover commission-eligible paid enrollments or services expressly designated by 67Figures within (a) the 67Figures 90-Day Fast Track Program and (b) Fresh Start Credit Housing (“FSCH”). The Open Affiliate tier is 10% of eligible, tracked, collected revenue. The Fast Track Affiliate tier is 20% and is limited to verified eligible participants in the 90-Day Fast Track Program who remain in good standing. Examples based on a $7,000 paid-in-full Fast Track enrollment are $700 and $1,400. Examples are illustrations only, not guarantees. Free affiliate enrollment does not mean that referred client services are free.

4. Qualifying referrals and attribution

A qualifying referral must use Affiliate’s assigned program link or code, be eligible under current written attribution rules, enroll in a specifically designated commission-eligible covered program or service, and result in cleared funds. The tracked program pathway must match the applicable offer. 67Figures records control attribution absent documented error. Self-referrals, duplicate leads, manipulated tracking, cookie stuffing, false identities, unauthorized incentives, spam, and misleading promotion are prohibited.

5. Payment, refunds, taxes, and offsets

Rewards are calculated and paid under the payout schedule in effect for the applicable enrollment and only after eligibility and collected-funds requirements are met. Refunds, disputes, failed payments, cancellations, financing reversals, and chargebacks may reduce, delay, reverse, or offset rewards. Affiliate is responsible for taxes and must provide a valid Form W-9 and payment information before payout. 67Figures may issue required tax forms.

6. Marketing and required disclosures

Affiliate must make clear and conspicuous disclosures when promoting 67Figures or FSCH, including: “I may receive compensation if you enroll through my link.” Affiliate may use only approved, current claims and materials; must not promise income, credit-score changes, credit deletion, funding, mortgage approval, purchasing timelines, closings, deals, results, or recovery of program cost; and must not impersonate 67Figures or FSCH or use deceptive domains, paid-search terms, testimonials, or advertising. Email, text, telephone, and social promotion must comply with applicable consent, advertising, privacy, and anti-spam laws.

7. FSCH scope and referring-professional relationship

FSCH provides credit education, readiness planning, homeownership preparation, and related support. It may help a referred client review credit and documentation, prepare for lender qualification, and consider appropriate traditional or lawful non-traditional acquisition paths. FSCH is not a lender and does not guarantee credit improvement, funding, prequalification, preapproval, mortgage approval, property acquisition, purchasing time, or closing. When a licensed real-estate professional identifies a referred client through the assigned link or code, FSCH will use commercially reasonable efforts to keep that professional associated with the referral and return the client to that professional whenever possible when the client is ready to resume a property search, subject to the client’s choice, consent, eligibility, applicable law, lender requirements, and any separate written relationship.

8. No regulated referral compensation

Rewards are solely for qualifying paid covered-program or service enrollments expressly designated as commission-eligible. They are not compensation for referring a real-estate transaction, brokerage client, mortgage application, loan, lender, title company, closing, settlement service, or other regulated service. Affiliate must comply with licensing laws, brokerage policies, fair-housing requirements, professional rules, and restrictions on outside compensation.

9. Independent contractor; no authority

Affiliate is an independent contractor and not an employee, broker, agent, partner, joint venturer, franchisee, fiduciary, lender, credit bureau, credit-reporting agency, or legal representative of 67Figures or FSCH. Affiliate has no authority to bind either program, negotiate terms, collect money, make warranties, or represent that an application, enrollment, credit result, or mortgage is approved.

10. Confidentiality and data protection

Affiliate must protect nonpublic 67Figures and FSCH information, referral data, customer information, training materials, pricing strategy, portal content, business processes, and credentials; use them only for authorized purposes; and promptly report suspected unauthorized access. Affiliate may not collect or transmit Social Security numbers, credit reports, bank records, passwords, or other sensitive client information through the affiliate application or ordinary email, and may not disclose client or transaction information without authorization. These duties survive termination.

11. Limited restrictive covenants; no general non-compete

This Agreement does not generally prevent Affiliate from practicing real estate, investing, operating another lawful business, or competing fairly. During the Agreement and for twelve months after termination, Affiliate may not: (a) use 67Figures or FSCH confidential information to divert or circumvent a tracked referral, applicant, customer, or business opportunity introduced solely through either program; (b) induce a person known through confidential program records to bypass 67Figures or FSCH for a substantially identical program transaction; (c) solicit program employees or contractors to leave for a competing program using confidential information; or (d) misuse program names, marks, materials, links, or tracking systems. These restrictions apply only to the relationships, information, and activities described and are intended to protect confidential information, goodwill, referral attribution, and brand integrity—not restrain ordinary lawful competition. A court or arbitrator may reform an overbroad restriction to the narrowest enforceable scope.

12. Intellectual property and brand use

67Figures grants a limited, revocable, nonexclusive, nontransferable license to use approved 67Figures and FSCH marketing materials during approved participation. All goodwill belongs to the applicable brand owner. Affiliate may not alter a brand, register confusing names or domains, create unauthorized pages or accounts, sublicense materials, or claim ownership of program intellectual property.

13. Term, suspension, and termination

Either party may terminate prospectively by written notice. 67Figures may suspend links, review disputed rewards, or terminate immediately for fraud, material breach, misleading claims, regulatory risk, harassment, spam, misuse of data or intellectual property, or conduct reasonably likely to harm customers or either brand. Accrued rewards remain subject to eligibility, verification, reversals, and surviving terms.

14. Disclaimers and limitation

No income, referral volume, enrollment, credit result, funding, mortgage approval, transaction, purchasing timeline, closing, business result, or program-cost recovery is guaranteed. Affiliate acts at their own expense and risk. To the fullest extent permitted by law, neither party is liable for indirect, special, incidental, exemplary, or consequential damages. Nothing excludes liability that cannot lawfully be limited.

15. Disputes and Texas law

The parties will first attempt good-faith written resolution, followed by mediation. Unresolved disputes will be decided by binding individual arbitration in Dallas County, Texas, unless applicable law requires another forum. Texas law governs without regard to conflict-of-law rules. Either party may seek temporary injunctive relief to protect confidential information, data, intellectual property, or referral tracking. Class or representative proceedings are waived to the extent lawful.

16. Privacy and records

67Figures may collect and use application, professional, license, company, signature, device, referral, program-interest, enrollment-attribution, payment-status, and tax information to evaluate applications, prevent fraud, administer links and rewards, satisfy legal obligations, and communicate about the program. Records may be shared with service providers, professional advisers, payment and tax providers, regulators, or legal authorities as reasonably necessary. Affiliate must keep contact information current and may request a copy of the electronically accepted record.

17. Entire agreement and changes

This Agreement, incorporated policies, and accepted tier terms are the entire affiliate agreement and supersede prior affiliate discussions. Waivers must be written. If a provision is unenforceable, the remainder continues. Material changes apply prospectively after notice and any required renewed acceptance. Affiliate may not assign this Agreement without written consent.

18. Electronic-signature consent

Affiliate consents to transact electronically, receive program records electronically, and use a typed name and checkbox action as an electronic signature. Affiliate may print or save this Agreement before submission and request a copy of the accepted version. Withdrawal of electronic consent ends online participation but does not invalidate records already signed.

Electronic signature requirements

To accept, the applicant must open this Agreement, complete applicable professional fields, check both acknowledgments, and type their full legal name exactly as entered in the application.
